This document sets out the rules for the processing of personal data (hereinafter also referred to as “data”) and cookies within the framework of the online store cleanwavepolska.pl, operated through the website available at URL: cleanwavepolska.pl, hereinafter referred to as the “Store”.

§1. HOW TO CONTACT THE DATA CONTROLLER

The administrator of the personal data processed within the Store is:

§2. ON WHAT BASIS DO WE PROCESS YOUR DATA

When collecting personal data, we always inform you of the legal basis for its processing. It stems from the provisions of the RODO (Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016). When we refer to:

  • Article 6(1)(a) of the RODO – this means that we process personal data on the basis of consent received.
  • Article 6(1)(b) of the RODO – this means that we process personal data because it is necessary for the performance of a contract or to take action at your request before entering into a contract.
  • Article 6(1)(c) of the RODO – this means that we process personal data in order to fulfill a legal obligation.
  • Article 6(1)(f) RODO – this means that we process personal data for legitimate interests.

§3. INFORMATION ON DATA PROCESSING FOR THE PURPOSE OF CONCLUDING AND PERFORMING CONTRACTS AND INVESTIGATING AND DEFENDING AGAINST CLAIMS

We may process personal data necessary for the performance of the contract concluded with you. However, even prior to its conclusion, we may process personal data necessary to take action on your request. We process this data on the basis of Article 6(1)(b) of the RODO.

During and after the execution of the contract, we process the personal data of a party to the contract in order to handle potential claims and their investigation. Our legitimate interest is, for example, to be able to respond to a potential claim. In this case, we will process personal data on the basis of our legitimate interest, which is the defense against or investigation of potential claims. We process this data on the basis of Article 6(1)(f) of the DPA.

Storage period: We will keep the data for the period necessary for the fulfillment of the specified purposes, but no longer than until the statute of limitations for claims under separate laws.

Provision of this data is voluntary, but failure to do so will prevent the conclusion or execution of the contract.

§4. INFORMATION ON DATA PROCESSING FOR SENDING THE NEWSLETTER

We allow you to subscribe to our newsletter. If you have used this functionality, we process your personal data in order to send it. The newsletter may contain advertising, commercial or marketing content. We process this data on the basis of your consent, and thus on the basis of Art. 6(1)(a) RODO.

You have the right to withdraw your consent at any time. However, withdrawal of consent does not affect the lawfulness of processing based on consent prior to its withdrawal. We will retain your data until you withdraw your consent.

Providing this data is voluntary, but failure to do so will prevent the newsletter from being sent.

§5. INFORMATION ON DATA PROCESSING FOR DIRECT MARKETING PURPOSES

We may process your personal data for direct marketing purposes. This happens, for example, when we respond to a user’s message with details of our offer. We process this data on the basis of Article 6(1)(f) of the RODO.

Provision of this data is voluntary, and failure to do so will prevent direct marketing activities.

§6. INFORMATION ON DATA PROCESSING FOR SECURITY PURPOSES

Since the launch of our website, we process data such as:

  • The public IP address of the device from which the request came,
  • browser type and language,
  • date and time of request,
  • The number of bytes sent by the server,
  • URL of the previously visited page,
  • Error information that occurred during the request.

Our legitimate interest in this processing is to keep server event logs and secure the Store from potential hacking attacks. The processing of this data is based on Article 6(1)(f) of the DPA.

Providing this data is a condition for using the Store. Failure to provide this data will prevent the use of the Store.

§7. INFORMATION ON DATA RECIPIENTS

We use third-party services when processing personal data. Accordingly, the recipients of personal data may be third parties:

  • Shipping service provider / couriers: DHL, DPD, FedEx, InPost, Rholig Suus, Poczta Polska
  • Hosting provider: WEBH.pl
  • Email service provider: Google Inc. 1600 Amphitheatre Pkwy, Mountain View, CA 94043, United States.
  • Advertising service provider: Google Inc. 1600 Amphitheatre Pkwy, Mountain View, CA 94043, United States.
  • Accounting service provider: I.T.A. Kancelaria Podatkowa Hruszowiec Jarosław, 18 Tadeusza Kościuszki Street, 58-100 Świdnica.
  • Provider of legal/advisory/collection services: these service providers are established on a case-by-case basis, as each need arises.
  • Provider of opinion collection service: Ceneo.pl Sp. z o.o., 182 Grunwaldzka St., 60-166 Poznań
  • Provider of electronic payment services: UAB “ZEN.COM”, Lvivo g. 25-104, Vilnius, Lithuania
  • Translation service provider: DeepL.

§8. INFORMATION ON TRANSFER OF DATA TO THIRD COUNTRIES

As we may use international providers (e.g. Google, Meta), your personal data may be transferred outside the European Economic Area (EEA), in particular to the United States of America (USA).

The transfer of data is based on appropriate legal mechanisms, such as European Commission decisions confirming an adequate level of data protection or standard contractual clauses approved by the European Commission.

§9. ABSOLUTE RIGHTS OF DATA SUBJECTS

The user has the following rights, regardless of the legal basis for processing:

  1. Right of access: the right to obtain from us confirmation as to whether we are processing your data, and information about that processing (Article 15 of the RODO).
  2. Right of rectification: the right to request immediate rectification of inaccurate data (Article 16 of RODO).
  3. Right to erasure of data (“right to be forgotten”): The right to request erasure of data if one of the circumstances set forth in Article 17 of the RODO applies.
  4. Right to restrict processing: the right to request restriction of processing in the cases specified in Article 18 of the RODO.
  5. Right to file a complaint: the right to file a complaint with the supervisory authority: President of the Office for Personal Data Protection, 2 Stawki Street, 00-193 Warsaw.

§10. CONDITIONAL RIGHTS OF DATA SUBJECTS

The user also has rights that depend on the legal basis for processing:

  • Right to withdraw consent: If your data is processed on the basis of consent, you have the right to withdraw it at any time.
  • Right to data portability: If the processing is based on consent or contract, you have the right to receive the data you provide in a structured format (Article 20 of the DPA).
  • Right to object: If your data is processed based on our legitimate interest, you have the right to object (Article 21 RODO).

§11. COOKIES – INTRODUCTION

The Store’s website uses cookies. These are small text files stored on the user’s device. We distinguish the following types of cookies:

  • Essential: They enable the proper functioning of the Store. Without them, the use of the Store is impossible.
  • Functional: Allow you to remember your settings and personalize the interface.
  • Business / Marketing: Enable marketing activities and traffic analysis.

§12. DATA CONTROLLER COOKIES

The cookies we administer allow us to authenticate access, maintain sessions, secure the Store and remember the contents of your shopping cart.

§13. THIRD-PARTY COOKIES

We use third-party tools and cookies, such as Google (Analytics, Ads) and Meta (Facebook Pixel). Their use is subject to the privacy policies of these entities.

§14. CONSENT TO USE AND MANAGE COOKIES

Consent to the processing of cookies is voluntary and can be withdrawn at any time. However, lack of consent for some cookies may limit the functionality of the Store. You can manage your consent through your browser settings.

§15 CACHE

When you use the Store’s website, we may automatically use the cache installed on your device to speed up page loading on subsequent visits.

§16. PIXEL TAGS

We may use pixel tag technology (e.g. Facebook Pixel) to record activity on the site and evaluate the effectiveness of ads.

§17. LINKS TO OTHER WEBSITES OR SOFTWARE

The store may contain links to other websites. We are not responsible for the privacy policies of these sites. We recommend you to read their privacy policies.

§18. CHANGES IN PRIVACY AND COOKIES POLICY

The Policy enters into force on the date of its publication on the Store’s website. The Policy is amended by publishing its new content on the Store’s website. Information about the change will be published on the Store’s website no later than 3 days before its new wording comes into effect.
